This website is owned and operated by SparkCrest Designs, a DBA of SparkCrest Digital, LLC. Throughout this website, the terms “we,” “us,” “our,” and “business” refer to SparkCrest Designs and/or SparkCrest Digital, LLC. By visiting our website, purchasing from our store, submitting a custom order request, or using our services, you agree to be bound by these Terms of Service, along with our Shipping Policy, Return Policy, Privacy Policy, Legal Notice, and any other policies posted on this website.

Online Store Terms: By using this website or placing an order, you confirm that you are at least the age of majority in your state or that you have permission from a parent or legal guardian to use this website and make purchases. You agree not to use our products, services, designs, website, or content for any unlawful, unauthorized, harmful, or infringing purpose.

Products and Services: SparkCrest Designs offers apparel, custom designs, print-on-demand products, team orders, group orders, digital design services, and related creative products. Many products are made-to-order and may be produced through third-party fulfillment partners, including Printify, Ninja Transfers, shipping carriers, and other production or service providers. Product availability, pricing, colors, sizes, materials, production times, and shipping times may vary.

Order Accuracy: Customers are responsible for carefully reviewing all order details before submitting an order. This includes product type, size, color, quantity, design selection, spelling, personalization, shipping address, billing information, and contact information. SparkCrest Designs is not responsible for customer mistakes after an order has been approved, submitted, or placed into production.

Custom Orders and Design Approval: For custom orders, customers may be asked to review and approve artwork, mockups, names, numbers, wording, spelling, colors, sizing, placement, or other design details before production. Once a design is approved or production has started, changes, cancellations, refunds, or replacements may not be available unless the item is defective or incorrect due to seller or production error.

Made-to-Order Products: Many products sold by SparkCrest Designs are made after the order is placed. Because of this, production time is separate from shipping time. Custom, personalized, team, name/number, special-order, or made-to-order items may be final sale unless they arrive damaged, defective, or incorrect due to seller or production error.

Pricing and Payment: Prices are listed in U.S. dollars unless otherwise stated. We reserve the right to update pricing, product availability, discounts, promotions, and product details at any time without prior notice. Payment must be received before an order is processed or placed into production. Orders may be delayed or canceled if payment is not received, declined, disputed, reversed, or flagged for suspected fraud.

Shipping and Delivery: Shipping times vary depending on production time, fulfillment partner, shipping carrier, customer location, holidays, weather, inventory availability, and other circumstances outside of our control. Estimated delivery dates are not guaranteed unless specifically stated in writing. Orders may ship in separate packages if multiple products or fulfillment partners are involved. Customers are responsible for providing an accurate and complete shipping address.

Returns, Exchanges, and Refunds: Returns must be requested within 14 days of delivery. Items must be unworn, unwashed, odor-free, unused, and in resellable condition unless the item is damaged, defective, or incorrect due to seller or production error. Approved returns may be subject to a restocking fee, and original shipping costs may be non-refundable unless otherwise required by law or approved by SparkCrest Designs. Custom, personalized, team, name/number, special-order, and made-to-order products may not be eligible for return or exchange unless defective or incorrect due to seller or production error.

Damaged, Defective, or Incorrect Items: If an item arrives damaged, defective, or incorrect, the customer must contact SparkCrest Designs within 14 days of delivery. Photos of the item, packaging, shipping label, and issue may be required before a replacement, refund, or other resolution is approved. Resolution decisions will be made on a case-by-case basis.

Customer-Provided Content: If a customer provides artwork, logos, images, names, phrases, school names, team names, business names, trademarks, copyrighted material, or any other content for a custom order, the customer confirms that they have the legal right or permission to use that content. The customer agrees that SparkCrest Designs is not responsible for copyright claims, trademark disputes, licensing issues, or legal disputes related to customer-provided content.

Refusal of Service: SparkCrest Designs reserves the right to refuse, cancel, or decline any order, custom request, design request, or service at our discretion. This may include, but is not limited to, orders involving offensive content, unlawful content, hateful content, infringing material, unsafe requests, suspected fraud, abusive behavior, or requests that violate our business standards or legal obligations.

Intellectual Property: All original artwork, designs, graphics, images, product mockups, logos, written content, website content, branding, and creative work produced by SparkCrest Designs or SparkCrest Digital, LLC remain the intellectual property of the business unless otherwise agreed in writing. Customers may not copy, reproduce, modify, resell, distribute, upload, or use our designs, images, mockups, branding, or website content without written permission.

Personal Use and Commercial Use: Purchasing a product from SparkCrest Designs does not give the customer ownership of the underlying artwork, design files, mockups, digital files, or intellectual property. Products are sold for personal use unless commercial use or licensing rights are specifically granted in writing.

Third-Party Services: Our website, payment processing, production, fulfillment, and shipping may involve third-party service providers. These providers may have their own terms, conditions, processing times, policies, and limitations. SparkCrest Designs is not responsible for third-party outages, delays, carrier issues, production delays, inventory shortages, or service interruptions, but we will make reasonable efforts to assist customers with order-related concerns.

Website Accuracy: We make reasonable efforts to provide accurate product descriptions, images, mockups, pricing, sizes, colors, and information. However, we do not guarantee that all website content will be error-free, complete, current, or exact. Product colors, print placement, size, and appearance may vary slightly due to screen settings, garment differences, production methods, and supplier variations.

Limitation of Liability: To the fullest extent permitted by law, SparkCrest Designs and SparkCrest Digital, LLC shall not be liable for indirect, incidental, special, consequential, punitive, or similar damages related to the use of this website, products, services, orders, shipping delays, third-party fulfillment issues, customer-provided content, or custom design work. Our liability, if any, shall be limited to the amount paid by the customer for the specific product or service at issue.

Indemnification: The customer agrees to hold harmless and indemnify SparkCrest Designs and SparkCrest Digital, LLC from claims, damages, losses, expenses, or legal issues arising from the customer’s misuse of our website, violation of these Terms of Service, violation of another party’s rights, or submission of customer-provided content that violates copyright, trademark, licensing, privacy, publicity, or other legal rights.

Changes to These Terms: SparkCrest Designs reserves the right to update, change, or replace these Terms of Service at any time. Updates will be posted on this page and will be effective immediately upon posting. Customers are encouraged to review this page periodically.

Governing Law: These Terms of Service shall be governed by and interpreted according to the laws of the state in which SparkCrest Digital, LLC is registered, without regard to conflict of law principles.
